NaSiam terms and conditions

1. Identity and contact details

These terms and conditions apply to the services of NaSiam Therapeutic Thai Massage, operated by Nalita Mangtaku, with enterprise number 0770.916.012 and VAT number BE 0770.916.012.

The business is referred to below as “NaSiam”, and the person who books or receives a treatment as “the customer”.

2. Application and acceptance

These terms apply to every appointment, booking, treatment and purchase of a gift voucher from NaSiam, regardless of whether it is made through Resevu, the website, by telephone, by message or on the premises.

Before completing a booking, the customer is given the opportunity to read and accept these terms. By confirming a booking or electronically signing the terms, the customer declares that they agree to them.

3. Bookings and prices

An appointment becomes final when the customer receives a booking confirmation. The customer must check the date, time, duration, selected treatment and contact details in the confirmation and report any errors as soon as possible.

The prices displayed during the booking process are the applicable total prices, including taxes where applicable. NaSiam is not bound by an obvious input, publication or pricing error. In that event, the customer will be informed as soon as possible and may cancel the booking without charge.

4. Payment

Unless stated otherwise during the booking process, the customer must pay no later than at the time of the treatment using a payment method accepted by NaSiam.

If advance payment or a deposit is required, this will be clearly stated before the booking is confirmed. Any cancellation fee may be deducted from an amount already paid. Any remaining balance will be refunded using the original payment method or, with the customer’s agreement, converted into credit.

5. Cancellation or rescheduling by the customer

The customer may cancel or reschedule an appointment by email, WhatsApp or telephone.

  • More than 24 hours before the appointment: cancellation is free of charge. An appointment may be rescheduled once without charge. For a subsequent change, the customer must cancel the existing appointment and make a new booking.
  • Less than 24 hours before the appointment: NaSiam is entitled to retain the deposit paid as a cancellation fee.
  • Failure to attend without prior cancellation: NaSiam may charge 100% of the booked treatment.

These fees cover the reserved time slot and the loss arising because that slot can generally no longer be offered to another customer. In exceptional and demonstrable circumstances, NaSiam may, as a gesture of goodwill, waive all or part of the fee.

6. Cancellation by NaSiam

NaSiam may cancel or reschedule an appointment when the treatment cannot be performed safely or reasonably, for example because of the therapist’s illness, a technical issue or force majeure. The customer will be informed as soon as possible. Amounts already paid will, at the customer’s choice, be refunded or applied to a new appointment.

If NaSiam cancels an appointment less than 24 hours in advance for a reason attributable to NaSiam, the customer will also receive credit equal to 50% of the booked treatment. This does not apply in cases of force majeure or where cancellation is necessary because of incorrect or incomplete information, inappropriate conduct or an unsafe situation caused by the customer.

7. Late arrival

The customer is requested to arrive on time. If the customer is late, the treatment may be shortened so that subsequent customers are not disadvantaged. The full price will remain payable.

If the customer arrives so late that a safe or meaningful treatment is no longer possible, NaSiam may treat the appointment as a late cancellation in accordance with Article 5.

If NaSiam starts late, the full booked treatment time will be respected whenever possible. If this is not possible, the price or credit will be adjusted proportionately.

8. Health, intake and customer responsibility

NaSiam’s massages and treatments are intended for wellbeing, relaxation and support with physical tension. They do not replace examination, diagnosis or treatment by a doctor, physiotherapist or other qualified healthcare professional. NaSiam does not make medical diagnoses and does not guarantee any particular result.

Before and during the treatment, the customer must provide accurate and complete information relevant to the safe performance of the treatment. In particular, the customer must disclose pregnancy, fever, infectious conditions, skin problems or open wounds, recent surgery or injuries, acute inflammation, thrombosis, serious heart or vascular conditions, cancer treatment, allergies, medication use and other relevant medical considerations.

If there is any doubt about the suitability of a treatment, the customer must seek medical advice beforehand. NaSiam may adapt, postpone, stop or refuse a treatment when reasonably considered necessary for the safety of the customer or therapist. If this results from information the customer should reasonably have disclosed beforehand, the booked price may remain payable.

The customer must immediately report pain, dizziness, numbness, shortness of breath or other discomfort. Pressure and technique will be adjusted where possible. The customer may ask for the treatment to be paused or stopped at any time. Stopping at the customer’s request does not automatically entitle the customer to a refund, unless NaSiam has failed to perform the treatment properly.

9. Personal boundaries and conduct

NaSiam provides professional therapeutic and wellness massages and treatments only. Sexual requests, touching or suggestions, harassment, discrimination, aggression, threats and any other inappropriate or boundary-crossing conduct are not accepted.

In the event of such conduct, NaSiam may immediately refuse or end the treatment and require the customer to leave the premises. The full price of the reserved time slot will remain payable. NaSiam may take further appropriate action where necessary.

The customer must not attend an appointment under the influence of alcohol or drugs. NaSiam may refuse the treatment when safe or respectful treatment is not possible as a result.

10. Minors

Treatments are generally intended for persons aged 18 or over. A minor may only receive a treatment with NaSiam’s prior approval and with demonstrable consent from a parent or legal guardian. NaSiam may require that person to be present during the intake or treatment.

11. Personal belongings

The customer remains responsible for personal belongings brought onto the premises. NaSiam is not liable for loss, theft or damage unless it results from a fault on the part of NaSiam. Lost property will be kept for a reasonable period.

12. Gift vouchers and credit

A gift voucher or credit may be used in accordance with the conditions and validity period stated when it is issued. A voucher cannot be exchanged for cash unless required by law. A lost or stolen voucher will only be replaced if the customer can provide proof of purchase and the voucher’s unique identification and if the voucher has not yet been used.

If the chosen treatment costs more than the voucher’s value, the customer must pay the difference. If the treatment costs less, the remaining credit will remain available until the stated expiry date, unless clearly specified otherwise when the voucher is issued.

13. Personal and health data

NaSiam processes personal data to manage bookings and invoices. NaSiam uses the Resevu booking system for this purpose. The use of Resevu does not remove NaSiam’s responsibility for processing carried out on NaSiam’s behalf.

Health information is sensitive and is processed only to the extent necessary for a safe, tailored treatment and where a valid legal basis exists. Where explicit consent is required, it will be requested separately. The customer may withdraw consent without affecting the lawfulness of earlier processing. If NaSiam cannot safely provide a treatment without necessary health information, the treatment may be adapted, postponed or refused.

14. Liability

NaSiam performs treatments carefully and professionally. NaSiam is liable for damage that is the direct result of an attributable fault in the performance of the agreement.

NaSiam is not liable for damage resulting from incorrect, incomplete or withheld information provided by the customer, failure to follow reasonable instructions, or a pre-existing condition that the customer failed to disclose despite its relevance to the treatment.

Nothing in these terms limits or excludes liability where this is not permitted by applicable law, including liability for wilful misconduct or gross negligence and for injury to the customer’s life or physical integrity caused by a fault on the part of NaSiam.

15. Complaints

A complaint should preferably be submitted as soon as possible to contact@nasiam.be , with a clear description and, where relevant, the appointment date. NaSiam aims to provide a substantive response within 14 calendar days.

The customer and NaSiam will first attempt to resolve any dispute by mutual consultation. Consumers may also contact the Consumer Mediation Service, North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels, via https://consumerombudsman.be .

16. Right of withdrawal for online or telephone bookings

There is no statutory right of withdrawal for massage appointments booked for a specific date and time, insofar as the appointment qualifies as a service related to leisure activities within the meaning of Article VI.53(12) of the Belgian Code of Economic Law. The contractual cancellation policy in Article 5 remains applicable.

17. Amendments and validity

NaSiam may amend these terms for future bookings. A booking is governed by the version accepted by the customer when that booking was made.

If any provision is found to be wholly or partly invalid or unenforceable, the remaining provisions will continue to apply. To the extent permitted by law, the invalid provision will be replaced by a valid provision that most closely reflects its purpose without disturbing the balance between the parties.

18. Applicable law, language and disputes

The agreement is governed by Belgian law, without prejudice to mandatory consumer protection to which the customer is entitled. Disputes will be submitted to the court having jurisdiction under applicable law.
